Leave for family reasons COVID-19 and Certificates of Incapacity for Work and Quarantine or Isolation Orders - Situation as of 15 February 2022

During these two years marked by the coronavirus pandemic, health measures adopted by the Government have been adjusted many times, each time taking into account the evolution of the sanitary situation.

In such a rapidly evolving context, it is not easy for a citizen to find their way around their rights, duties and administrative formalities.

Many insureds have contacted the National Health Fund (CNS) over the past two years to submit a request for family leave (COVID-19) or a quarantine or isolation order.

But what documents should an insured person send to the CNS and by which deadlines?

Leave for family reasons in connection with the COVID-19 pandemic (hereinafter CRF-COVID-19)

As part of the measures implemented in schools and childcare facilities to combat the spread of the coronavirus, a child may have to be placed in quarantine or isolation by order or recommendation of the Health Directorate (Direction de la Santé) or the competent authority.

In March 2020, the Government therefore introduced a special "leave for family reasons in connection with the COVID-19 pandemic". The provisions and procedures related to this leave have evolved over the last two years.

Today, what documents does the CNS need in order to record a CRF-COVID-19?

The parent who needs to use the CRF-COVID-19 must first fill in the COVID-19 family leave form

Then, depending on the given situation (boxes to be ticked on the form), different documents must be included with the application.

The official documents vary from country to country:

Luxembourg

  • Quarantine/isolation order for the child issued by the Health Directorate (Direction de la Santé)
  • School closure certificate issued by the Ministry of National Education and Youth (MENJE)

France

  • Official document issued by the health insurance for contact cases and school closures. Furthermore, a document showing proof of incapacity for work can be requested through declare.ameli if a certificate of incapacity for work is needed
  • School closure certificate in the name of the child issued by the competent authority (e.g. school management, commune, etc.)

Belgium

  • Medical certificate confirming quarantine/isolation or a recommendation for quarantine/isolation issued by the competent authority
  • Certificate of school closure in the name of the child issued by the competent authority (e.g. school management, commune, etc.)

Germany

  • Official quarantine/isolation document issued by the Gesundheitsamt/-behörde of the competent Land
  • School closure certificate issued by the competent authority (e.g. school management, municipality, etc.) in the name of the child

All these documents must be issued in the name of the child. Similarly, the CNS may request proof of a positive PCR test of the person/child concerned.

Certificates of incapacity for work and quarantine/isolation orders

A person who has a confirmed infection with COVID-19 must go into isolation; a quarantine applies to people who have had high-risk contact with a person with a confirmed infection.

What documentation does the CNS require to register an isolation or a quarantine?

The official documents vary from country to country:

  • Luxembourg: Isolation order or quarantine order issued by the Health Directorate (Direction de la Santé)
  • France: Official quarantine or isolation order. This order must come from the competent national authority (the CPAM via the teledeclare service, declare.ameli).
  • Belgium: Medical certificate confirming quarantine/isolation or a recommendation for quarantine/isolation issued by the competent authority
  • Germany: Quarantine/isolation order issued by the competent Gesundheitsamt/-behörde of the respective Land of residence

All these documents serve as certificates of incapacity for work for the CNS to record a period of incapacity for work.

The documents must be nominative (if sent electronically, e.g. by e-mail...). In some cases, the CNS may request proof of a positive PCR test.

Submission, deadlines and delays

With the increase in the number of positive COVID-19 cases, waiting times for issuing quarantine or isolation orders is also increasing, both in Luxembourg and in neighbouring countries. The CNS is aware that the competent authorities are currently facing delays and mainly takes into account the date of issue of these documents.

Upon receipt of the document(s), the insured person can send:

  • The application for the CRF-COVID-19 either by email to cns-crf@secu.lu or by post to CNS - Indemnités pécuniaires - L-2980 Luxembourg. The application must be complete. There is no point in sending an application to the CNS without enclosing the required official documents.
  • The quarantine or isolation order either by email to saisieCIT.cns@secu.lu or by post to CNS - Indemnités pécuniaires - L-2980 Luxembourg.
