Conditions

A progressive return to work for therapeutic reasons (RPTRT) is possible under the following conditions.

Request from the attending physician and the insured person

The request for progressive return to work is made using the standard form "Request for progressive return to work for therapeutic reasons", where the attending physician certifies that a progressive return to work for therapeutic reasons promotes the improvement of the insured's state of health.

The application is duly completed and signed by both the attending physician and the insured person.

Incapacity for work

The insured person must be unable to work at the time of the request. In addition, the insured must have been unable to work for at least one month out of the three months preceding the request.

Employer's consent

The employer must give their consent to their employee's progressive return to work for therapeutic reasons by signing the standard form handed to them by their employee.

Prior agreement of the CNS

The progressive return to work for therapeutic reasons may only begin once the CNS has given its consent, based on a reasoned opinion from the Medical Board of the Social Security.

Steps to be taken

The application form duly completed and signed by the attending physician and the insured person, certifying the beneficial effect of a progressive return to work on the insured person's state of health, must be submitted to the employer.

If the employer agrees with the progressive return to work for therapeutic reasons, the request must be sent to the CNS for approval.

Upon receipt, the CNS asks the Medical Board of the Social Security to take a position on the request. The decision will be notified to the insured person and the employer as soon as possible.

The insured person may gradually return to work after receiving the CNS's agreement.

Important information

The progressive return to work for therapeutic reasons is 100% compensated by the CNS, provided that the payment charge is the responsibility of the CNS.

In the event of incapacity for work, the employee is entitled to the continued payment of their salary from their employer until the end of the calendar month in which the 77th day of incapacity for work falls, calculated over a reference period of 18 successive calendar months. Then, from the month following the 77th day of illness, the financial benefits are paid by the CNS.

During the period of progressive return to work for therapeutic reasons, the insured person is considered to be fully incapacitated for work.

A medical certificate of full-time (100%) incapacity for work must therefore be submitted.

The RPTRT period is fully included in the calculation of periods of incapacity for work to determine the end date of entitlement to financial compensation (78 weeks over a period of 104 weeks).

If the incapacity for work is interrupted, the RPTRT measure is terminated (e. g. legal leave).
