Adopting a child
After patiently waiting and preparing for the adoption, we finally received confirmation that our child would be arriving in our home, and it's vital for me to be able to offer them all the support and attention they need during this important transition.
Everything I need to know
- The conditions
- My steps
- My compensation
What conditions must I meet to be entitled to leave?
I am entitled to 12 weeks' leave to welcome my adopted child if I meet these three conditions:
- The adoption procedure is completed with my spouse;
- The adopted child is under the age of 12;
- I am employed or self-employed and have completed at least six months of compulsory affiliation in the 12 months prior to the adoption leave.
Good to know: if my spouse and I both meet the conditions for taking childcare leave, we will mutually agree on who should apply for adoption leave.
If I apply for leave and it is granted, my spouse will no longer be able to apply.
What do I have to do to get the leave?
I submit my application, giving my contact details and the desired start date of the leave. This request must be accompanied by a certificate from the court stating that the adoption procedure has been initiated (adoption petition) or an approval to continue the procedure, issued by the Ministry of Education, Children and Youth.
If I am self-employed, I will receive a certificate from the CNS stating that I am interrupting my professional activity for the duration of my adoption leave and indicating the date on which I will resume my activity.
I am sending this certificate, completed and signed, to the following address (no need to stamp the envelope):
Caisse nationale de santé
Indemnités pécuniaires
L-2980 Luxembourg
What happens to my compensation during my adoption leave?
The financial compensation paid to me (employee or self-employed person) for my adoption leave is calculated in the same way as my financial compensation for sickness. It may not exceed five times the reference minimum social wage.
