Adoption of a child

After a period of waiting and preparation, confirmation has been received that a child is coming to live with the employee. It is essential to ensure that the new family member receives the necessary support and attention during this important transition.

Eligibility conditions for adoption leave

Authorisation for 12 weeks' leave to welcome an adopted child may be granted if the following conditions are met:

  • The adoption procedure is completed jointly with the partner or spouse;
  • The adopted child is under 12 years of age;
  • The beneficiary is an employee or self-employed person who has completed a compulsory affiliation period of at least six months in the 12 months preceding the adoption leave.

Good to know: If both parents meet the conditions to benefit from adoption leave, they must decide by mutual agreement which of them will apply for it.

Once leave has been granted to one of them, it can no longer be requested by the other.

Procedures for obtaining leave to welcome a child

To apply for adoption leave, you must submit a request specifying your contact details and the desired start date for the leave. This request must be accompanied by a certificate from the court confirming that the adoption procedure has been initiated (adoption petition) or approval to continue the procedure, issued by the Ministry of Education, Children and Youth.

In the case of self-employment, the CNS will provide a sworn statement to be completed, declaring the interruption of the professional activity for the duration of the adoption leave, with the expected date of resumption of activity.

Benefits during welcome leave?

The cash benefit paid during adoption leave (for employees and the self-employed) is calculated in the same way as sick pay. It cannot exceed five times the social minimum wage.
