Family hospice leave
When a loved one is at the end of their life, it is essential to be able to provide them with all the necessary support during this difficult period.
Special leave is provided to enable people to accompany a loved one in their final moments, offering them the opportunity to be fully present.
In a nutshell
Special leave may be authorised to care for a close relative suffering from a serious and terminal illness. If the care is shared between several people, the total duration of the authorised leave may not exceed a predefined limit. The leave request must be sent to the CNS, accompanied by a medical certificate and a completed form.

Eligibility conditions for accompanying leave
Special leave to accompany a terminally ill relative may be authorised if the applicant is:
- An employee;
- A civil servant of the State, a municipality or a public institution;
- An employee of the State, a municipality or a public institution;
- Worker for the State, a municipality or a public institution.
On the other hand, special leave will be authorised if the person being accompanied is:
- A direct relative (mother, daughter, mother-in-law or daughter-in-law, father, son, father-in-law or son-in-law);
- A sister or sister-in-law, a brother or brother-in-law;
- The spouse or legally recognised partner.
Length of family hospice leave
The maximum length of family hospice leave may not exceed 5 working days (40 hours) per relative per year. However, it may be split up or taken on a part-time basis with the employer's consent.
Good to know: In the case of part-time work, the right to a maximum of 40 hours of family hospice leave is also guaranteed.
Shared family hospice leave
When several relatives request family hospice leave for the same relative at the end of their life, the total duration of the leave granted may not exceed 40 hours.
Family hospice leave ends on the date of the death of the relative.
Procedures for obtaining family hospice leave
Sending the application to the CNS
To apply for family hospice leave, the form 'Attestation pour l'octroi d'un congé d'accompagnement' (certificate of entitlement to family hospice leave) must be sent to the CNS, duly completed by the doctor, certifying the serious and terminal illness of the person to be accompanied.
The form 'Demande d'octroi d'un congé d'accompagnement d'une personne en fin de vie' (application for family hospice leave to accompany a person at the end of life) must also be completed and attached to the application.
Good to know: If the person at the end of their life does not have a 13-digit Luxembourg identification number, a copy of their birth certificate, family record book or identity card must be provided.
Receipt of approval from the CNS
Once the leave has been granted, the CNS will send a family leave booklet to the address provided, containing:
- A set of supporting forms labelled 'Justificatif d'absence pour congé d'accompagnement' (justification of absence for family hospice leave)
- Individual labels (40 in total) to be attached to it. Each label corresponds to one hour of family hospice leave.
Good to know: The CNS issues a single family leave booklet. If the leave is shared with other people, it must be made available to the other beneficiaries.
Information for the employer
The employer must be informed no later than the first day of absence for family hospice leave.
Each time leave is taken, the ‘'justification of absence for family hospice leave' must be completed, with the appropriate number of labels affixed (one label per hour of leave), and then sent to the employer.
If the leave is shared, each beneficiary follows the same procedure with their employer.
Salary during family hospice leave
Continuation of the employee's remuneration
During family hospice leave, the employer continues to pay the salary/wage.
Reimbursement of salaries advanced by the employer
The Employers' Mutual Insurance Fund (Mutualité des employeurs-MDE) can reimburse the employer for salaries paid in the event of incapacity for work of its employees, provided that these periods are declared to the Social Security Centre (Centre commun de la sécurité sociale (CCSS)). It is therefore important to declare the days of absence to assist a relative at the end of life (family hospice leave), in order to guarantee the reimbursement of advanced salaries.

Le congé pour l’accompagnement d’une personne en fin de vie permet au demandeur de s’abstenir de travailler afin de rester au chevet d’un proche atteint d’une grave maladie en phase terminale.

Attestation pour l'octroi d'un congé d'accompagnement
Cette attestation est établie en vue de l’obtention d’un congé d’accompagnement conformément à la loi du 16 mars 2009 relative aux soins palliatifs, à la directive anticipée et à l’accompagnement en fin de vie. L’attestation est à joindre à la demande pour l’octroi d’un congé d’accompagnement.

Justificatif d'absence pour congé d'accompagnement
Le justificatif d’absence est à transmettre à l’employeur. Le bénéficiaire est obligé d’avertir personnellement ou par personne interposée, soit oralement soit par écrit, l’employeur ou le représentant de celui-ci au plus tard le premier jour de son absence. A la demande de son employeur ou de la caisse de maladie, le salarié doit prouver que les différentes conditions pour l’obtention du congé d’accompagnement sont remplies.
